d-pad lite problem?

well i got my mitts on the gorgeous (but fingerprint magnet) black ds lite. overall im very happy, the screens are just the business, the new stylus is great, the new design is just plain wow and....well i dont really need to tell u guys n gals about it.
however the dpad on my lite seems to have problems detecting diagonal movement. it works but i sometimes have to press really hard to get it to work, which can be frustrating in games like MPH. the directions all work fine if i just want to go in one direction but diagonals are a problem. ive looked around a bit and apparently its mostly the black lites that are having this problem (some whites are also effected).
is anyone else having this prob and does it fix itself over time?

I'm hesitant to call it a design flaw since everyone seems so pleased with the new control scheme, so I'd e-mail nintendo and see what they say.
