Ahh, I don't think that's legal. If you have the cartridge and you play it in its original form, you're sticking to the copyright law, but if you own it in another form as a copy, as long as you didn't buy it in that form, it's illegal, even if the copy is for "safekeeping." As far as I know, the only way to legally acquire and own a ROM is if you extract it from the media (cartridge, card, etc.) yourself. Plus the backup needs to go with the original media or be destroyed when you sell or give the game away. So that essentially makes it illegal except to make a backup which most people wouldn't need anyway.

You can't buy TTDS for about 3 weeks becuase of Chinese new year. They have stopped production:P
