Someone on the NSider forums emailed them.

i've seen multiple emails from nintendo saying that it was intentional and i've seen multiple saying its not.

so theres no proof, at all.

The email responses were apparently personal opinions from uninformed customer service reps. I remember an interview with someone high up in Nintendo or involved with MKDS development, I'll see if I can find it.
