That's my personal understanding, but currently my stance is that PS1 and N64 are debatable, simply because the software is widely available in most GameStop's/EBgames. The hardware's discontinued, but the software is still available. However, the argument there is that they're all used games, thus, not technically retail (they're on the secondary market).
Definitly Legal: Arcade, Atari, NES, SNES, Genesis, Saturn, Game Boy, Game Boy Color, Game Gear, anything else pre-1996
Legal Gray Area: PS1, N64, Dreamcast
Definitly Illegal: PC, PS2, Gamecube, Xbox, Xbox 360, DS, PSP, GB
Personally, I wouldn't worry too much about the debatable ones. However, even if it is debatable, remember the ESA fights their debates with multi-million dollar lawyers...
